GENERAL TERMS AND CONDITIONS FOR TICKET PURCHASE (VISITORS)

1. Scope

1.1 Scope and Definitions:

These General Terms and Conditions ("Terms") govern the relationship between prismXevents UG, Lukasstrasse 6, 50823 Cologne ("Organizer") and ticket buyers ("You," "Buyer," or "Visitor"). By purchasing tickets, you acknowledge and accept these Terms. Any Buyer-specific terms become part of the contract only if agreed in writing by the Organizer.

2. Contract Conclusion, Content, and Unilateral Termination

2.1 Conclusion of the Contract:

Ticket purchases, are confirmed upon order confirmation or ticket dispatch. Until full payment, Tickets remain the Organizer's property. Access to the event is granted upon payment completion.

2.2 Content of the Contract, Access Rights, and Age Restrictions:

Buyers gain access to the event area, subject to Organizer discretion on program changes. Sale of Tickets to those under 18 is prohibited, and minors are not allowed access, even with a legal representative.

2.3 No Right to Unilateral Termination:

As a leisure service, the Consumer Protection Act does not grant the Buyer the right to unilaterally terminate the ticket sale contract.

3. Ticket Validity

Tickets allow access to the event area for the specified individual. Ticket validity ends upon leaving the event area; reuse is prohibited.

4. Return, Refund, Event Relocation, and Force Majeure

4.1 Return of Tickets:

Buyers can return Tickets and receive a refund if the event is postponed or canceled for reasons the Organizer is responsible for. Refund requests must be submitted within four weeks of the event date.

4.2 Event Postponement due to Force Majeure:

In cases of force majeure, the Organizer may postpone the event with no refund unless attendance on the new date is impossible. The Organizer informs Buyers promptly about any changes.

4.3 No Refund of Additional Fees:

Additional fees for services (e.g. pre-booking fees) are non-refundable.

4.4 Cancellation Process:

Cancellations are not permitted. Refunds can be requested through our customer service email address.

5. Limited Ticket Acquisition, Transfer Prohibition, and Raffles

5.1 No Transfer to Third Parties:

Transfer of contract rights and obligations to third parties is prohibited.

5.2 No Tickets via Raffles/Prize Games:

Acquiring Tickets through raffles or prize games without Organizer consent results in ticket invalidation.

6. Private Use, Ticket Personalization, Entrance Bracelets, and Loss

6.1 Private Use and Ticket Personalization:

Buyers may purchase Tickets for private use, personalized with the Visitor's full name, surname, and date of birth.

6.2 Entrance Bracelets:

Upon identity verification through an official document, Tickets are exchanged for non-transferable entrance bracelets. Sale or transfer of entrance bracelets is prohibited.

6.3 Loss of Tickets and Entrance Bracelets:

Lost Tickets or Entrance Bracelets are not replaceable, and the right to attend the event is forfeited.

7. Liability

7.1 Organizer's Liability:

The Organizer is liable for damages to life, body, and health in connection with the event, in case the culpability can be attributed to the Organizer. For essential contractual obligations, liability is limited to foreseeable, usual damages; gross negligence or willful breach of contract triggers full liability.

7.2 Organizer's Legal Representatives:

Exclusions and limitations apply to the Organizer's legal representatives and staff.

8. Visual and Audio Recordings

Production of commercial video and audio recordings is not allowed. The Organizer reserves the right to limit recording devices and take action against unauthorized publications.

9. Organizer's Rights

9.1 Closing Parts and Limiting Spectators:

For security or operational reasons, the Organizer may close or limit certain event areas without refund entitlement.

9.2 Audio and Video Recordings by the Organizer:

The Organizer holds exclusive rights to audio and video recordings. Unauthorized distribution may result in legal action.

9.3 Visitor Exclusion:

The Organizer may exclude Visitors for significant reasons, with no refund entitlement.

10. Applicable Law, Competent Court

10.1 Applicable Law:

German law applies, respecting consumer protection laws of the Buyer's residence.

10.2 Competent Court:

For consumer claims, the court is per the Buyer's residence; for merchants, the court is per the Organizer's seat.

11. Minimum Number of Participants

11.1 The bus tour will only take place if the minimum number of participants of 20 is reached. The minimum number of participants must be reached no later than 14 days before the start of the tour. If the minimum number of participants is not reached, participants will be informed by e-mail no later than 7 days before the start of the tour. In this case, the price for this service will be refunded.

11.2 Individual departure points may be cancelled if they are not on the route to the destination or if at least 10 people have not been confirmed.

12. Final Provisions

12.1 No Additional Agreements:

No agreements or obligations exist beyond these General Terms and Conditions.

12.2 Null and Void Provisions:

Null or void provisions don't affect other clauses; applicable legal provisions replace them.
